This notice describes the nature of the content hosted on Fanprose (the “Service”), the legal basis on which it is made available, and the disclaimers applicable to it. It supplements, and should be read together with, our Terms of Service, DMCA & Copyright Policy, and Content Guidelines. In the event of any conflict, the Terms of Service govern.

1. User-Generated Content

Fanprose operates as an online hosting platform. All content made available through the Service, including works of fan fiction and photocard images (collectively, “User Content”), is created, submitted, and uploaded by users of the Service. Users retain ownership of their User Content. Fanprose does not claim ownership of User Content and does not assert any right, title, or interest in the source materials on which such content may be based.

The taxonomy used to organize the Service is likewise User Content. The catalog of individuals (“idols”) and associated groups is not derived from, supplied by, or licensed from any official or authoritative source. It is created and curated by users, is generated from the tags that users apply to their fan fiction, and is recorded in our database as user-submitted entries. Fanprose does not maintain an official or authoritative record of any individual or organization; such designations constitute user-supplied metadata used solely to categorize and organize User Content.

2. Transformative Nature of Fan Fiction

Fan fiction published on the Service consists of non-commercial, transformative works authored by users. Fanprose believes that such works generally constitute fair use under United States copyright law. Fanprose asserts no ownership over the characters, settings, or source materials from which such works may be derived. Copyright matters are addressed in our DMCA & Copyright Policy and Content Guidelines.

3. Fan-Made Nature of Photocards

Photocards are collectible items uploaded and exchanged by users as non-commercial fan creations. Photocards are not official merchandise and are not manufactured, produced, licensed, authorized, sponsored, or endorsed by any artist, performer, group, management agency, record label, or other rights holder. The names, images, and likenesses of any individuals depicted remain the property of their respective owners. No content on the Service should be construed as indicating any affiliation with, or endorsement by, any such party.

4. No Affiliation

Fanprose is an independent fan community. It is not affiliated with, sponsored by, authorized by, or endorsed by any media franchise, brand, individual, or entity referenced within User Content. All trademarks, service marks, trade names, and likenesses referenced on the Service are the property of their respective owners. As described in Section 1, the names of individuals and groups appearing on the Service are user-supplied designations used to organize User Content and do not signify any endorsement, participation, or official relationship.

5. Rights Holder Notices and Safe Harbor

Because User Content is submitted by users, Fanprose functions as an online service provider and maintains a notice-and-takedown procedure consistent with the Digital Millennium Copyright Act (DMCA). A rights holder, including any individual asserting a right of publicity or a concern regarding the use of their likeness, may request the removal of content. Fanprose responds promptly to valid notices and terminates the accounts of repeat infringers in appropriate circumstances.

Copyright takedown notices and counter-notices must be submitted in accordance with the procedure set out in our DMCA & Copyright Policy and directed to dmca@fanprose.com. Concerns relating to likeness, right of publicity, or other content matters may be directed to moderation@fanprose.com.

6. User Responsibilities

Users are responsible for ensuring that they hold all rights necessary to submit and share their User Content. Users must not infringe the intellectual property or other rights of any third party beyond the scope of fair use and transformative fan works. Additional obligations are set out in Section 4 of our Terms of Service and in our Content Guidelines.
