DMCA & Copyright Policy

Fanprose respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). This policy describes how copyright holders can report alleged infringement and how users can respond to takedown notices.
1. Fan Fiction & Fair Use
Fanprose hosts fan fiction — transformative, non-commercial works created by fans. We believe fan fiction generally constitutes fair use under U.S. copyright law. However, we take all DMCA notices seriously and will respond promptly to valid claims.
2. Filing a DMCA Takedown Notice
If you believe that content on Fanprose infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing, including its URL on Fanprose.
- Your contact information (name, address, phone number, and email).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

3. What Happens After a Takedown Notice
- We will promptly remove or disable access to the reported content.
- We will notify the user who posted the content and provide them with a copy of the takedown notice.
- The user may submit a counter-notice (see below).
4. Filing a Counter-Notice
If you believe your content was removed by mistake or misidentification, you may file a counter-notice. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the URL where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and phone number.
- A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original takedown notice.

5. Restoration
If we receive a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed content.
6. Repeat Infringers
In accordance with the DMCA, we will terminate the accounts of users who are found to be repeat infringers in appropriate circumstances.
7. Plagiarism Between Fan Authors
While not strictly a DMCA matter, Fanprose also prohibits plagiarizing other fan fiction authors’ original creative work. If you believe another user has copied your fan fiction, please report it to moderation@fanprose.com with links to both works.
